    1.  Port Authority of New South Wales (Port Authority) operates the website www.portauthoritynsw.com.au (Website).  These Terms of Use comprise of these terms and any other instruction or terms appearing within the Website.  These Terms of Use may be updated from time to time without notice to you.

    2.  By using the Website, you warrant that you have had sufficient opportunity to access these Terms of Use and contact us, and you have read, accepted and will comply with these Terms of Use.  If you do not agree to these Terms of Use, please do not use the Website.

    Obligations of Users

    3.  You must not:

    (a) use this Website for other than for lawful purposes;

    (b) use the Website for any activities which breach any laws or infringe a right of Port Authority or any third party’s rights;

    Copyright in Website (including text, graphics, logos, icons, sound recordings, databases and software) is owned by or licensed to Port Authority.  You do not have any right, title or interest in Website.  You must not enter into any agreements or arrangements with another person to restrict Port Authority’s access or use of the Website.

    5.  Other than for purposes expressly authorised by these Terms of Use, you must not copy, adapt, reproduce, store, publish or commercialise any information provided on SHIPS without Port Authority’s prior written permission.

    6.  You agree to provide information, including intellectual property, to Port Authority as requested within SHIPS.

    7.  You:

    (a) warrant that you have all necessary rights to provide the information to us;

    (b)  grant us a perpetual, non-exclusive, royalty-free, irrevocable, worldwide and transferable right and licence to use the intellectual property submitted by you in SHIPS in any way;

    (c) when acting as an agent, you warrant that you have the authority of the relevant principal to provide the information and bind the principal;

    (d) consent to any act or omission which would otherwise constitute an infringement of your moral rights;

    8.  If you (or any employee or agent) have moral rights in any intellectual property that you provide to us, you irrevocably consent to any amendment, use or application of the intellectual property submitted by you in SHIPS in any manner and without attribution of authorship by Port Authority or its licensee and successors in title;
